These Terms and Conditions govern your use of our digital memorial services, including digital memorial displays on headstones, headstone cards, and hosting services. By purchasing our services, you agree to comply with these terms.
1. Digital Memorial Updates
Unlimited Updates: We offer unlimited updates to your digital memorial for the first nine (9) months following purchase. After this period, updates will be processed in scheduled batches (e.g., quarterly or biannually) to ensure efficient service.
Update Requests: All update requests must be submitted in the required format (e.g., digital files, approved text) to ensure proper implementation.
2. Headstone Cards
Unlimited Replacement Cards: We provide unlimited replacement headstone cards per year due to damage, wear, or other defects.
Limitations: Replacements are limited to one (1) card per request, and excessive requests may be reviewed for potential misuse.
Damage Verification: We reserve the right to request proof of damage before processing a replacement.
3. Lifetime Hosting
Minimum Hosting Period: We guarantee lifetime hosting of your digital memorial for a minimum of ten (10) years from the date of purchase.
Extended Hosting: After the initial 10-year period, we will continue hosting as long as our services remain operational. However, we reserve the right to discontinue hosting with prior notice due to business, technical, or legal reasons.
Data Backup: While we take reasonable measures to protect your data, we are not liable for data loss due to unforeseen circumstances (e.g., server failures, cyberattacks).
4. Service Modifications & Discontinuation
We reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice.
If we discontinue hosting, we will provide options for data retrieval where possible.
5. Limitation of Liability
Our liability is limited to the cost of the services provided. We are not responsible for indirect, incidental, or consequential damages.
We do not guarantee uninterrupted service and are not liable for delays caused by third-party providers or technical issues.
6. Refunds & Cancellations
Due to the custom nature of our services, refunds are only available under specific conditions (e.g., failure to deliver as agreed).
Cancellation requests must be submitted in writing, and any applicable refunds will be assessed on a case-by-case basis.
7. Governing Law
These Terms and Conditions are governed by UK laws, and any disputes will be resolved in the appropriate courts therein.
